About these terms
These Terms of Service apply to de-alwis.com and the associated tools and projects I operate that link to these terms, including The Source KWI. I’m Keith De Alwis, based in Dubai, United Arab Emirates. In these terms, “I” and “me” refer to Keith De Alwis, and “you” refers to the person using the services.
These terms set out the basis on which the services are made available. Please read them before using the services. If you do not agree, please stop using them. Where a feature requires express acceptance, you must accept before using that feature. Nothing here treats a visit as consent to marketing or data processing that requires separate consent.
A separate written agreement may apply to a particular engagement or service. If there is a conflict, that agreement takes priority for the engagement or service it covers. Personal information is handled as described in the Privacy Policy.
Using the services
You may use the website and available tools for lawful purposes, within the functionality and access made available to you. You must have the legal capacity and authority needed for your use. If you act for an organisation, you must have its permission.
You must not:
- Use the services to break the law, infringe another person’s rights, impersonate someone or submit deceptive or abusive material.
- Attempt to access private systems, accounts, credentials or information without permission.
- Introduce malicious code, disrupt the services, overload them or bypass security checks, access restrictions or usage limits.
- Use automated access in a way that interferes with availability or circumvents restrictions. Ordinary search-engine indexing of publicly accessible pages is permitted, subject to published crawling instructions.
- Use information obtained through a connected account for purposes outside the account holder’s authorisation or applicable provider rules.
You are responsible for activity you initiate and for keeping credentials under your control confidential. Tell me promptly if you believe access has been misused.
Content and downloads
Unless stated otherwise, the original text, design and other material I create for this website belong to me. Third-party photographs, logos, quotations, software, datasets and other material remain subject to their respective owners’ rights and licences. Describing an open-source project does not make every part of this website open source.
You may read, link to and use the publicly available content for your own learning and internal business reference. You may download resources offered for that purpose and quote brief extracts with clear attribution and a link to the source, subject to any third-party rights. Do not remove credits or notices, present the material as your own, or resell or republish substantial parts without permission, unless an applicable licence or law allows it.
A licence or usage notice supplied with a particular resource takes priority for that resource. You retain any rights you have in your own inputs. Reports generated for you may be used for your own research and internal business decisions, subject to the source providers’ terms and rights.
Articles, guides, case studies, directories and tool outputs are provided for general information. Examples and estimates are not guarantees of results or advice tailored to your circumstances. Check source material, dates, assumptions and suitability before relying on them. Obtain appropriate professional advice where needed.
Information you provide
Please provide accurate information and only material you are entitled to share. Do not submit passwords, access tokens or sensitive personal information through ordinary enquiry forms or keyword research inputs.
You retain your rights in information you provide. You give me permission to process it only as needed to respond to your request or provide the functionality you choose, in accordance with the Privacy Policy and any separate agreement. Sending an enquiry does not by itself create a consultancy engagement, confidentiality agreement or other professional relationship.
Public forms are not intended for confidential business documents. Contact me to agree appropriate arrangements before sharing confidential material.
Newsletter and resources
The Sunday Blueprint and resource-request forms explain what you are signing up for. Some download requests include newsletter subscription, as stated beside the form. You can unsubscribe using the link in an email or by contacting me at keith@de-alwis.com.
A contact-form enquiry alone does not subscribe you to the newsletter. Delivery times and publication frequency may change. A resource may be updated or withdrawn, and information in an existing download may become out of date.
Tools and Google connections
The Source KWI provides keyword research and intelligence using authorised access to the Google Ads API. Its outputs may include keyword ideas, search-volume estimates, bid ranges, advertiser competition, public-search analysis and research recommendations.
Only connect a Google account if you are its holder or are authorised to do so. Google OAuth asks you to authorise access through Google. You remain responsible for deciding whether to grant the requested permission. The current tool uses the Google Ads permission for keyword research and does not create or change advertising campaigns.
You can revoke access through your Google Account’s third-party connections. Connected features may stop working after revocation. Revocation does not automatically delete reports already generated; see the Google data section of the Privacy Policy for handling and deletion requests.
Google’s applicable terms and API policies also apply to Google services. Access depends on Google’s permissions, quotas, availability and approval requirements. These terms do not grant additional rights to Google data or replace Google’s rules.
Keyword metrics, rankings, scores and recommendations are estimates or analytical outputs. They do not guarantee search rankings, advertising performance, revenue or any other outcome. Advertiser competition is not the same as organic search difficulty. Review the assumptions and exercise your own judgement before making publishing, purchasing or campaign decisions.
Third-party services
The website may link to or use services operated by others, including video platforms, form and email providers, and Google services. Those providers control their services and may impose their own terms, limits and privacy practices.
A link, directory entry, logo or reference does not by itself mean endorsement, partnership or a guarantee of a third party’s products or services. Review the relevant provider’s information before relying on or using its service.
Paid engagements
These terms do not set prices, payment obligations, deliverables, refund rules or service levels for consulting or other paid work. Those matters must be agreed separately before a paid engagement begins. An enquiry or request for information does not commit either of us to an engagement.
If a paid feature is offered through a tool, its price and applicable terms must be made clear before you agree to purchase it. Nothing in these terms removes rights you have under applicable consumer law.
Availability and changes
I aim to keep the services useful and working, but uninterrupted availability, compatibility with every device, and error-free or complete information are not guaranteed. Features may change, be limited or be withdrawn for maintenance, security, legal requirements or operational reasons.
I may restrict or suspend access where reasonably necessary to address misuse, a breach of these terms or a security or legal risk. Where practical and appropriate, I will explain the reason and how to resolve it. Any commitments in a separate paid-service agreement remain subject to that agreement.
You may stop using the services at any time. Keep copies of reports or resources you need, subject to their applicable rights and licences.
Responsibility and liability
To the extent permitted by applicable law, the website, free resources and tools are provided as available, without additional promises about their accuracy, suitability or fitness for a particular purpose. You should independently assess information and outputs before acting on them.
To the extent permitted by law, I am not responsible for indirect or consequential losses, or business losses such as lost profit, revenue or opportunity, arising from use of the free website, resources or tools. This does not override any express commitment in a separate agreement.
Nothing in these terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability or statutory right that cannot lawfully be excluded or limited. Any limitation applies only to the extent the law allows.
General terms and contact
The latest terms will be published at this address with an updated date. Changes apply going forward. Where a material change requires notice or express acceptance, that will be provided before the change applies to you. Updating this page does not retrospectively change a separate agreement.
If part of these terms is found unenforceable, the remaining provisions continue to apply so far as the law permits. A delay in enforcing a provision does not by itself waive the right to enforce it.
If you have a concern or dispute, contact me first so we can try to resolve it. These terms do not require arbitration or remove access to a court, regulator or other remedy available under applicable law. Any governing-law or jurisdiction provision in a separate agreement applies to the services covered by that agreement.
